These Terms of Service ("Terms") govern your access to and use of the website bankablefunds.com, the Bankability Score engine, and any related services (collectively, the "Services") provided by Bankable Capital LLC ("Bankable," "we," "us," or "our"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. What Bankable Is
Bankable is a technology and funding-facilitation company. We are not a bank, a direct lender, or an SBA-approved lender. We operate a proprietary Bankability Score engine that evaluates your business and matches you with third-party funding partners. We do not make credit decisions or extend credit ourselves.
2. The Bankability Score
The Bankability Score is a proprietary, informational assessment based on the information you provide. It is not a credit score, a credit decision, or a guarantee of funding. It does not involve a hard credit inquiry. Funding partners make their own independent decisions using their own criteria.
3. No Guarantee of Funding
Submitting information or an application does not guarantee that you will be approved for funding, or that any particular amount, rate, or term will be offered. Approval, amounts, rates, and terms are determined solely by the funding partners and depend on your business profile and their requirements.
4. Your Responsibilities
- You must provide accurate, current, and complete information.
- You must be at least 18 years old and authorized to act on behalf of your business.
- You are responsible for the confidentiality of any account credentials and for activity under your account.
- You agree not to misuse the Services, attempt unauthorized access, or use the Services for any unlawful purpose.
5. Third-Party Funding Partners
When you apply, we may share your information with funding partners so they can evaluate your application. Your relationship with any funding partner is governed by that partner's own terms and agreements. Bankable is not responsible for the products, decisions, or conduct of third-party funding partners.
6. Intellectual Property
The Services, including the Bankability Score engine, software, content, and branding, are owned by Bankable Capital LLC and protected by applicable intellectual-property laws. You may not copy, reverse engineer, or create derivative works from the Services without our written permission.
7. Disclaimers
The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. Nothing on the site constitutes financial, legal, or tax advice.
8. Limitation of Liability
To the maximum extent permitted by law, Bankable Capital LLC and its officers, members, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Services.
9. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.
10. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
